How Can You Tell if You Have a Personal Injury Case?

If you've recently been injured in an accident, then you might be wondering if you can claim compensation on a personal injury basis. While there are many reasons why you can make a case, typically your problems should fall into one or more of these three categories.

1. Someone Else Caused the Accident

Many personal injury lawsuits come about because of the actions of other people rather than anything you did. Here, you won't necessarily have done anything wrong to cause your accident.

For example, say you're crossing the road via a pedestrian crossing. The crossing lights at the intersection are green, so you have right of way. However, a driver is chatting on their mobile phone and doesn't see their red light. They carry on over the intersection, run the red light and knock you down.

The blame for this accident is on the driver. They injured you because of their actions. So you might be able to lodge a compensation claim if you have any injuries.

2. The Accident Was Preventable

People often bring personal injury lawsuits because they were injured because of someone else's negligence. You have an accident because someone didn't do something they should have done to prevent accidents.

For example, say you are in a supermarket and slip on a wet floor and break your ankle. The floor is wet because someone else dropped a jar of food. You didn't see the wet floor, stepped on it and slipped.

Here, you could argue the case that the store should have dealt with the spill. They should have cleaned it up or, at the very least, put hazard signs around it to tell people to avoid the area. If they failed to act to make the floor safe, they might be at fault for your accident.

3. You Have Medical Injuries

You can't lodge a claim for a personal accident without some form of injury that requires medical treatment. While this injury can sometimes be psychological, it's more often physical.

So a broken ankle from a slip in a supermarket would qualify for compensation if you can prove negligence. Injuries from a traffic accident are also valid.
